1. Commission and Payment Terms

1. The Agent shall be entitled to a commission of 1.5% (one point five percent) of the final sale price of the Vehicle.

2. Upon completion of the sale, the Seller shall provide written confirmation of:

   • The identity of the buyer, and

   • The final agreed sale price.

3. The Agent reserves the right to request proof of sale price (such as a copy of the bank transfer, invoice, or receipt).

4. An invoice for commission will be issued by the Agent once sale is confirmed. Payment must be made by the Seller within 7 working days of the invoice date.

5. Failure to pay commission, deliberate misrepresentation of the sale price, or concealment of a sale may result in legal proceedings to recover the commission and associated costs.

2. Right to Market the Vehicle
The Seller grants Flynn Anthony Cars the non-exclusive right to photograph, advertise, and market the Vehicle across its chosen platforms, including but not limited to online marketplaces, enthusiast communities, social media, and its website, for the purpose of securing a buyer.

3. Seller’s Obligations

The Seller warrants and undertakes that:

• They are the legal and rightful owner of the Vehicle and have the authority to sell it.

• The Vehicle is free of finance, liens, or undisclosed charges, unless otherwise stated in writing.

• All information, documents, and representations provided about the Vehicle are true and accurate.

• They will notify the Agent immediately if the Vehicle is sold through another channel or withdrawn from the market during the exclusivity period.

4. Agent’s Obligations

The Agent shall:

• Use reasonable care and skill to market and promote the Vehicle.

• Pass on all genuine enquiries and interested buyers to the Seller for further discussions, viewings, and completion of sale.

• Keep the Seller informed of marketing activity relating to the Vehicle.

5. Liability

The Agent acts solely as an introducer and marketing service. The Seller is responsible for conducting viewings, negotiating directly with buyers, and completing the legal transfer of the Vehicle. The Agent accepts no liability for any dispute between the Seller and Buyer.

6. Termination

Either party may terminate this Agreement early with 7 days’ written notice, subject to payment of any commission due if a sale has been introduced during the Agreement period.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
